Terms of Business
Twist & Hardy
These Terms of Business govern all sales of goods by Twist & Hardy (“we”, “us”, “our”) to the purchaser (“you”, “the Buyer”). By placing an order, you agree to be bound by these terms.
Twist & Hardy operates as a UK sole trader business.

1. Nature of the Goods
Twist & Hardy specialises in antique and vintage furniture and objects chosen for their craftsmanship, presence and enduring character.
All items are pre-owned and will show signs of age, use and historical wear consistent with their provenance. Primitive and vernacular pieces may include historic repairs, timber splices, iron reinforcements, shrinkage, movement, surface variation, historic worm and other timeworn characteristics. These are integral to the authenticity and aesthetic integrity of the piece and are not defects.
Descriptions, dimensions and photographs are provided in good faith. Measurements are approximate. Colour appearance may vary depending on lighting and screen settings.

2. Environmental Conditions
Antique furniture is made from natural materials that respond to their surroundings.
Central heating, underfloor heating, air conditioning and fluctuations in humidity may cause shrinkage, expansion, minor separation, surface movement or tonal variation. These characteristics are inherent to solid timber and traditional construction and do not constitute fault.
The Buyer is responsible for maintaining an environment suitable for antique furniture.

3. Formation of Contract
A contract for sale is formed when:
- Full cleared payment has been received; and
- Written confirmation of the order has been issued.
Items remain available until payment in full is received. We reserve the right to withdraw or cancel an order prior to dispatch in the event of error, unavailability or unforeseen circumstance, in which case a full refund will be issued.

4. Price & Payment
All prices are stated in GBP unless otherwise specified.
Payment must be made in full via website checkout or bank transfer prior to dispatch. No goods will be released until cleared funds have been received.

5. Title & Risk
Legal title to the goods passes only upon receipt of full payment.
Risk transfers upon delivery to the address specified in the order, or upon collection.
Delivery is deemed complete once the goods have been delivered to the agreed address.

6. Delivery, Access & Storage
Delivery timeframes are estimates and cannot be guaranteed.
The Buyer is responsible for:
- Providing accurate delivery information
- Ensuring safe and adequate access
- Confirming the item will fit through entrances and into its intended space
Additional costs arising from failed delivery or access issues may be charged.
Where goods are ready for dispatch or collection and the Buyer delays unreasonably, reasonable storage charges may apply.

7. Consumer Right to Cancel (Distance Sales)
If you are a consumer (as defined by the Regulations) purchasing online without prior in-person viewing, you have the right to cancel within 14 days of receiving the goods, in accordance with the Consumer Contracts Regulations 2013.
Cancellation must be confirmed in writing within this period. You then have a further 14 days to return the goods.
Returned goods must:
- Be in the same condition as supplied
- Not have been altered, cleaned, treated or repaired
- Be securely packaged and fully insured
The goods remain your responsibility until safely received by us.
Return shipping costs are the Buyer’s responsibility unless the goods are faulty or materially misdescribed.
Original outbound delivery costs are non-refundable unless legally required.

8. Refunds
Refunds will be processed within 14 days of safe return and inspection, via the original payment method.
We reserve the right to make a reasonable deduction for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.

9. Exclusions
The right to cancel does not apply to:
- Goods viewed and purchased in person
- Business-to-business transactions
- Commissioned sourcing
- Items altered at the Buyer’s request
Such sales are final unless otherwise agreed in writing.

10. Designer & Project Purchases
Where goods are purchased for an interior design project, the Buyer is responsible for confirming suitability of scale, access and installation environment prior to purchase.
Project timelines, contractor arrangements and installation scheduling remain the Buyer’s responsibility.
Twist & Hardy is not liable for project delay, contractor costs, aesthetic preference or environmental movement inherent in antique materials.

11. International Sales, Duties & Customs
For deliveries outside the United Kingdom:
- The Buyer is responsible for all import duties, customs charges, local taxes and clearance fees.
- Such charges are not included in the purchase price or delivery cost unless expressly agreed in writing.
- Delays caused by customs processes are outside our control.
If a shipment is refused due to unpaid customs charges, any return costs, duties or losses incurred may be deducted from any applicable refund.

12. Damage in Transit
Any damage or material discrepancy must be reported within 48 hours of delivery, with supporting photographs and packaging retained.
Failure to notify within this timeframe may affect the ability to pursue a claim.

13. Limitation of Liability
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any matter which cannot be excluded by law.
Subject to this, our liability shall be limited to the purchase price of the goods supplied.
We shall not be liable for indirect or consequential loss, including project delay, loss of profit, business interruption or aesthetic dissatisfaction.

14. Force Majeure
We shall not be liable for delay or failure to perform obligations due to events beyond our reasonable control, including transport disruption, customs delays, strikes or natural events.

15. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
